Terms of Service

1. Acceptance of Terms

By accessing or using VowRadar ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

VowRadar provides advisory growth intelligence tools for Etsy wedding sellers. The Service includes keyword research, listing audits, competitor analysis, seasonal planning, and AI-powered suggestions. VowRadar does not automatically edit Etsy listings — all suggestions and recommendations are provided for manual seller review and implementation.

3. Suggestions Only

VowRadar provides AI-generated and rule-based recommendations for informational purposes only. Sellers remain solely responsible for reviewing, approving, and manually applying any changes to their Etsy listings. VowRadar does not make any changes to your Etsy shop, listings, or account on your behalf. We do not guarantee any specific results, revenue increases, or search ranking improvements from following our suggestions.

4. Account Registration

To use certain features of the Service, you must register for an account. You may register using your email address and a password, or through Google Sign-In ("Sign in with Google"). You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for all activities that occur under your account. You must be at least 18 years of age to create an account.

If you use Google Sign-In, you authorize VowRadar to access your Google account basic profile information (name and email address) as permitted by Google's API policies. You may revoke this access at any time through your Google account settings.

5. Billing & Payments

Access to premium features is sold through Stripe as recurring monthly or annual subscriptions. Monthly access is billed at $30 per month until canceled. Annual access is billed at $270 per year until canceled, which equals 9 months of monthly charges for a full year of access. All prices are listed in US dollars. We reserve the right to change our pricing at any time; however, price changes will not affect an active subscription until the next renewal period where required by applicable law or Stripe notice requirements.

6. Refund Policy

We offer refunds within 7 days of purchase if you are not satisfied with the Service. To request a refund, please contact our support team at [email protected]. Refunds are processed to the original payment method and may take 5-10 business days to appear. Refunds are not available after the 7-day window except at our sole discretion.

7. Acceptable Use

You agree not to use VowRadar to:

  • Scrape, crawl, or otherwise collect data from Etsy in violation of their Terms of Service or API Terms of Use
  • Bypass Etsy APIs or use proxy-based data collection methods
  • Violate any marketplace rules, regulations, or policies
  • Use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service
  • Attempt to gain unauthorized access to any part of the Service or any system or network connected to the Service
  • Use automated tools or bots to access the Service in a manner that exceeds reasonable usage limits
  • Resell, redistribute, or make available Etsy data obtained through the Service to third parties
  • Use data obtained through the Service to compete directly with Etsy or VowRadar
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Create multiple accounts to circumvent usage limits or restrictions

8. Etsy API Compliance

The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

VowRadar uses the Etsy API in accordance with Etsy's API Terms of Use. Specifically:

  • We only access data that you have explicitly authorized through the Etsy OAuth connection process
  • We do not store your Etsy credentials (username or password)
  • Etsy OAuth access tokens are encrypted at rest and refreshed according to Etsy's token lifecycle
  • We comply with Etsy's API rate limits and usage restrictions
  • We do not use Etsy data for purposes other than providing the Service to you
  • We do not display Etsy data in a manner that misrepresents the source or ownership of the data
  • You may disconnect your Etsy shop at any time, which will revoke our API access and stop data synchronization

Violation of Etsy's API Terms of Use through your use of the Service may result in immediate suspension of your account.

9. Account Suspension & Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason we deem appropriate. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including without limitation: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may delete your account at any time through your account settings or by contacting us. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy.

10. Intellectual Property

The Service and its original content (excluding content provided by users or third-party data), features, and functionality are and will remain the exclusive property of VowRadar and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

You retain all rights to your own data, including your Etsy shop data, listing content, and any modifications you make based on our suggestions. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service.

11. Data & Privacy

We take your data privacy seriously. Please review our Privacy Policy for information on how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information in accordance with our Privacy Policy.

12. Indemnification

You agree to defend, indemnify, and hold harmless VowRadar and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party, including Etsy's rights or the rights of other Etsy sellers.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VowRadar SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL VowRadar'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO VowRadar IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

14. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VowRadar MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VowRadar DOES NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION OBTAINED FROM VowRadar SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

15. DMCA & Copyright

VowRadar respects intellectual property rights. If you believe that any content on the Service infringes your copyright, please contact us at [email protected] with: (a) a description of the copyrighted work you claim has been infringed; (b) a description of where the allegedly infringing material is located on the Service; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the "Last updated" date. What constitutes a material change will be determined at our sole discretion. Continued use of the Service after any such changes constitutes acceptance of the new Terms.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved first through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English and may be held remotely.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against VowRadar.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and VowRadar regarding the use of the Service, superseding any prior agreements between you and VowRadar relating to the Service.
